Terms and Conditions

1.. The Website provides information, education, telehealth services (including GLP-1 prescribing), and pharmacy fulfillment (through contracted third-party pharmacies) to users (“you” or “Customer”).

2. Eligibility & Account Registration

  • Age & Capacity: You must be at least 18 years old (or the age of majority in your jurisdiction) to form a binding contract. If you are a minor in your jurisdiction, your parent or guardian must agree to these Terms on your behalf.
     
  • Geographic Restrictions: You must reside in a state where Evolve and its healthcare providers are licensed to practice.
     
  • Account Registration: Certain services require you to register for a Customer Account with a username and password. You represent that all registration information is truthful and accurate, and you will keep it up to date. We may suspend or terminate your account for any violation of these Terms.
     
  • Security: You are responsible for maintaining confidentiality of your login credentials and for all activity under your account. Notify us immediately at admin@evolveme.us of any unauthorized use. Always log out and secure your devices when not in use.
     

3. Scope of Services

  • Telehealth Services: Delivery of medical consultations, prescription services, and follow-up via electronic communications. A doctor–patient relationship is formed only when a licensed provider conducts a consult and issues a prescription.
     
  • Pharmacy Fulfillment: We partner with third-party pharmacies to dispense and ship your prescriptions. We do not dispense medications directly.
     

4. Medical Disclaimers & Consent

  • No Emergency Care: Do not use the Website for emergencies.
     
  • Telehealth Consent: You must review and agree to an informed consent (“Patient Consent”) before using telehealth services.
     
  • Limitations: Telehealth may be limited by connectivity, incomplete information, or legal restrictions. We reserve the right to refuse or terminate services if clinically appropriate or prohibited by law.
     
  • Recordings: Consultations may be audio- or video-recorded for quality and training. These recordings are confidential and will not be shared publicly except as required by law.
     

5. Fees, Billing & Refunds

  • Consult & Subscription Fees: Service fees and medication subscription fees (e.g., weight-management programs) are disclosed at checkout. Unless otherwise stated, subscriptions auto-renew on the renewal date.
     
  • Auto-Renewal & Cancellation: You authorize us to charge your payment method at each renewal. To avoid renewal, cancel at least 72 hours before the renewal date by emailing admin@evolveme.us.
     
  • Administrative Cancellation Fee: If you cancel after payment but before your prescription is transmitted to the pharmacy, a $99 administrative fee applies. Once dispensed, no refunds.
     
  • Late Payments & Collections: Payments not received by due date are delinquent. After three days of failed collection attempts, a $30 late fee applies. Continued non-payment may incur additional fees, suspension of services, and referral to collections.
     

6. Privacy & Security

  • HIPAA & PHI: Evolve is not itself a “covered entity” under HIPAA, though our pharmacy and provider partners may be. We treat your protected health information (“PHI”) in accordance with our Privacy Policy. Non-PHI data is handled per applicable laws.
     
  • Your Responsibilities: You must maintain your own secure internet connection and hardware.
     
  • Electronic Communications: By providing your email and mobile number, you consent to receive texts, calls, and emails from us. Message/data rates may apply. Reply STOP to opt out of texts (though this may limit service functionality).
     

7. Intellectual Property

  • Ownership: All Website content—text, images, software—is owned by Evolve or its licensors. You are granted a limited, non-exclusive license to use the Website for personal health purposes.
     
  • Restrictions: No reverse engineering, scraping, or unauthorized use of our trademarks or content is allowed.
     

8. User Conduct

You agree not to misuse the Website or services, including:

  • Impersonation, harassment, or fraudulent activity
     
  • Uploading harmful code or unsolicited advertising
     
  • Accessing others’ accounts or data
     
  • Violating any laws or third-party rights
     

We reserve the right to suspend or terminate access for violations.


9. Third-Party Providers & Services

  • Independent Providers: We may connect you with third-party medical providers (the “Providers”) and pharmacies. Those entities are responsible for the care and services they provide. By using our services, you may form a medical provider–patient relationship with them, not with Evolve directly.
     
  • No Liability: Evolve is not responsible for the actions or omissions of these third parties. You agree to resolve any disputes with them directly and to indemnify Evolve against related claims.
     

10. Warranties & Limitations of Liability

  • No Medical Guarantees: We make no promises about specific health outcomes.
     
  • “As Is” Basis: The Website and services are provided “as is.” We disclaim all warranties, express or implied, to the fullest extent permitted by law.
     
  • Limitation of Liability: Our total liability for any claim arising from these Terms or the Website is limited to the fees you paid us in the 12 months prior to the claim. We are not liable for indirect, incidental, or consequential damages.
     

11. Indemnification

You agree to defend and indemnify Evolve, its affiliates, officers, agents, and employees from any claims, losses, or damages arising from your breach of these Terms or your use of the Website.


12. Governing Law & Dispute Resolution

  • Governing Law: These Terms are governed by the laws of California without regard to conflict-of-law rules.
     
  • Arbitration: All disputes must be resolved by binding arbitration in Chino, California, under the American Arbitration Association rules. You waive any right to class or representative actions.
     

13. Changes to Terms

We may update these Terms at any time by posting the revised version on the Website. Your continued use after posting constitutes acceptance. Please review periodically.
